Terms & Conditions

These terms and conditions apply to the supply of all Goods sold or services provided by Adamco Limited t/a discountoffice.co.nz to the Buyer, unless otherwise agreed in writing by the Seller.


Definitions

1.1   “Seller” shall mean Adamco Limited t/a discountoffice.co.nz and its successors and assigns.
1.2   “Buyer” shall mean the Buyer or any person or Seller acting on behalf of and with the authority of the Buyer.
1.3   “Goods” shall mean any item on the website discountoffice.co.nz supplied by the Seller to the Buyer.
1.4   “Price” shall mean the cost of the Goods as agreed between the Seller and the Buyer.

Acceptance

Any instructions received by the Seller from the Buyer for the supply of Goods shall constitute acceptance of the terms and conditions contained herein. Upon acceptance of these terms and conditions by the Buyer the terms and conditions are irrevocable and can only be rescinded in accordance with these terms and conditions or with the written consent of the management of the Seller.

None of the Seller’s agents or representatives are authorised to make any representations, statements, conditions or agreements not expressed by the management of the Seller in writing nor is the Seller bound by any such unauthorised statements.

Prices, Specifications, Policies and Payment

All prices include Goods and Services Tax (GST). Seller reserves the right to update Prices, specifications and policies at any time without notice. While every effort has been made to ensure the Prices and specifications of our product are as accurate and as up to date as possible, however, given the nature of the Goods we supply, the availability, Price or specifications of Goods can change rapidly. We therefore accept no liability should any of the Goods be unavailable or if Prices or specifications differ from those presented on this web site.

The Seller shall be under no liability whatsoever to the Buyer for any indirect loss and/or expense (including loss of profit) suffered by the Buyer arising out of a breach by the Seller of these terms and conditions. 

Payments can be made by either Visa or Mastercard credit cards or electronic transfer into seller’s account. Credit cards are not charged until we are ready to prepare shipment of your order or within seven days of receiving your order, whichever is earlier. Your credit card details are protected with SSL encryption and processed securely in real time by Shopify and/or Afterpay. Discount Office does not keep a record of your credit card number.

In using the Seller's Transaction Processing Service for purchases of the Goods, the Buyer represents and warrants that he/she is over 18 and has the legal capacity to contract in New Zealand. As the Buyer is using a credit card to process a transaction, the Buyer represents and warrants that the credit card is issued in his or her personal name and that the Buyer shall pay to the issuer all charges incurred through the use of Transaction Processing Services.

Freight and Delivery

Most orders with a combined value of over $30 including GST will be delivered free of charge however all orders to rural address will be charged $5 per order for rural deliver. The delivery fee for orders under $30 is $5.00 (including GST) to all centres. Where delivery address is a rural address, $5 rural delivery charge will apply above the normal delivery charges. Some large or bulky items such as box/s of paper may not qualify for free delivery. Some items have a per item delivery fee that is charged IN ADDITION TO the standard delivery fee. The delivery fee for these items starts at $3 (including GST) for the first item while each extra item is $2 (including GST) plus $5 for rural address. Seller will inform the Buyer of any additional charges prior to dispatch.

We aim to ship out orders as early as possible. For printer consumables, orders received by 3:30pm on a business day will be dispatched on the same day. For all other items, orders received before 10am on a business day will be dispatched on the same day subject to availability of stock at our warehouse. Where items are not in stock, it can take up to another 2 business days to dispatch those items. Our standard dispatch time is 2 to 3 days but no longer than 7 days.

Dates given for shipment or delivery are for guideline purposes only but are not to be treated as a condition of sale.

We use courier services to deliver all supplies. All deliveries to main centres and regions on North Island of New Zealand are by overnight courier. Deliveries to South Island of New Zealand are either by overnight or 2 day courier depending on the size of package/s. Where deliveries are to rural and provincial destinations, delivery may take up to 2 to 3 business days.

The following islands in New Zealand are excluded from free shipping: Arapaoa Island, Chatham Island, Great Barrier Island, Kawau Island, Matakana Island, Motiti Island, Pitt Island and Stewart Island. Customer will be notified of the delivery charges prior to order being processed.

All items dispatched by courier are ‘Signature Required’ unless request for ‘No Signature’ is made when placing order.

Bulky items and custom orders have a longer lead time than standard and may be delivered separately to other items in your order.

The Seller may deliver the Goods by separate instalments (in accordance with any agreed delivery schedule). Each separate instalment shall be invoiced and paid for in accordance with the provisions in this contract of sale.

Seller will do all things possible in delivering Goods to you as fast as possible but it cannot be responsible for any loss whatsoever sustained by the Buyer for delay in delivery.

The failure of the Seller to deliver shall not entitle either party to treat this contract as cancelled.

The Seller shall not be liable for any loss or damage whatsoever due to failure by the Seller to deliver the Goods (or any of them) promptly or at all.

Notwithstanding that the Seller may have delayed or failed to deliver the Goods (or any of them) promptly, the Buyer shall be bound to accept delivery and to pay for the Goods in full provided that delivery shall be tendered at any time within 14 days of the delivery date or any date agreed by both parties in writing.

International Customers

We do not offer international shipping. 

Return and Credit Policy

discountoffice.co.nz doesn’t have a retail outlet which helps us reduce our overhead costs. We pass our savings to consumers by offering discounted prices.

For this reason we urge Buyers to carefully select the product as returning will be possible where wrong item/s or faulty item/s is/are supplied by Seller as per Consumer Guarantees Act and Fair Trading Act.

Where wrong item/s is/are supplied by the Seller, collection and replacement will be arranged by the Seller.

If it’s a faulty product, the Buyer must inform the Seller of the defects within 5 days of receiving the delivery. An Authorisation number will be given which must be written on the address label. Seller will provide address to return to.

All authorised returns should be in original pack, must have all packing material, blank warranty cards, manuals and accessories. No address, address labels or courier tickets to be on the original pack.

Faulty products will be referred to manufacturers or their representatives for assessment and cause of the fault. If they are repairable, that will be done. If they are not repairable, those items will be replaced.

Where there is user fault, we will inform Buyer of the manufacturers or their representative’s assessment.

While the Consumer Guarantees Act and Fair Trading Act provide the basis for our returns policy, in certain cases we will go above and beyond the expectation of these two statutory laws. We will do our best to accept selected item/s. A 20% re-stocking fee plus the cost of out-bound delivery may apply.

Buyer will have to request for Return Authorisation prior to such return. Return shipping will be buyer’s responsibility.

Repairs

We’ll repair faulty goods under a manufacturer’s warranty. If unrepairable, we’ll replace the item. Where the same item is not available, a similar item of the similar specifications and price will be provided.

Risk and Ownership of the Goods 

Risk in the Goods shall pass to the Buyer upon delivery to the Buyer or to the address specified by the Buyer. If a carrier is used to effect delivery, delivery to the carrier shall constitute delivery to the Buyer, and all claims for Goods damaged in transit shall be made to the carrier immediately after the delivery of the Goods to the Buyer.

The Buyer shall inspect the Goods on delivery and shall within seven (7) days of delivery notify the Seller of any alleged defect, shortage in quantity, damage or failure to comply with the description or quote. The Buyer shall afford the Seller an opportunity to inspect the Goods within a reasonable time following delivery. If the Buyer shall fail to comply with these provisions the Goods shall be conclusively presumed to be in accordance with the terms and conditions and free from any defect or damage.

The Seller shall be under no liability whatsoever to the Buyer for any indirect loss and/or expense (including loss of profit) suffered by the Buyer arising out of a breach by the Seller of these terms and conditions.

Pending cleared payment in full of all monies due under this contract or in respect of any other monies owed by you to the Seller, the Goods shall remain the sole and absolute property of Seller as legal and equitable owner.

Privacy Act/Collection of Overdue Monies

Seller may collect any information provided by you. This information will be used to maintain and operate your account with the Seller, maintain and monitor our website, and to provide you with information regarding any new or existing products and services offered by the Seller and selected third parties from time to time. Any information collected by the Seller will be held by the Seller and the Seller's agents. You may request access to and correction of your personal information any time by contacting the Seller at shop@discountoffice.co.nz.

If the Buyer defaults in payment of any invoice when due, the Buyer shall indemnify the Seller from and against all the Seller’s costs and disbursements including a solicitor and own client basis and in addition all debt collection costs.

You agree that you will upon demand pay all expenses and legal costs incurred in the collection of all overdue monies by the Seller. 

Without prejudice to any other remedies the Seller may have, if at any time the Buyer is in breach of any obligation (including those relating to payment), the Seller may suspend or terminate the supply of Goods to the Buyer and any of its other obligations under the terms and conditions. The Seller will not be liable to the Buyer for any loss or damage the Buyer suffers because the Seller exercised its rights under this clause.

Title

It is the intention of the Seller and agreed by the Buyer that property in the Goods shall not pass until the Buyer has paid all amounts owing for the particular Goods, and the Buyer has met all other obligations due by the Buyer to the Seller in respect of all contracts between the Seller and the Buyer, and that the Goods, or proceeds of the sale of the Goods, shall be kept separate until the Seller shall have received payment and all other obligations of the Buyer are met. 

Changes to this Agreement

Adamco Limited reserves the right to review these terms and conditions at any time and from time to time.
